Terms of Service

BriefDuty is operated by Heimdall [registered company name and ACN to be inserted] (“we”, “us”), based in Western Australia.

By creating an account or using BriefDuty you agree to these terms. If you are agreeing on behalf of a business, you confirm you have authority to bind it. In these terms “you” means that business.

BriefDuty lets you write safety briefs, have them drafted and translated by an AI assistant, publish them to a public link or QR code, and keep a record of who has read them.

BriefDuty is a tool for delivering and recording safety information. It is not a safety consultancy, and nothing in the product is legal, regulatory or safety advice. You are responsible for deciding what your briefs must contain and for meeting your own obligations under work health and safety law.

You sign in with an email address and password. Keep your credentials secure — you are responsible for activity under your account.

Your organisation is a tenant. You may invite team members to a tenant and assign them roles, and those roles determine what each person can see and change. You are responsible for who you invite and for removing people who should no longer have access.

The number of tenants and briefs available to you depends on your plan.

You agree not to:

• Upload content you do not have the right to use, or that infringes someone else's rights.
• Publish unlawful, misleading or deliberately harmful content through a brief.
• Use the service to store sensitive personal information beyond what a safety brief reasonably needs.
• Attempt to access another tenant's data, probe or interfere with the service, or work around plan limits.
• Resell or white-label the service without our written agreement.

You own the content you put into BriefDuty. Uploading it does not transfer ownership to us.

You grant us a non-exclusive licence to host, store, reproduce, translate and display that content — to the extent needed to run the service for you. Translation necessarily means sending text to our AI provider, and publishing necessarily means serving your brief to anyone with the link.

We may also review samples of brief content to improve the quality of the assistant's output. This covers the text and media you author. It does not cover reader records: we do not use the names, email addresses or timestamps left by the people who read your briefs for any purpose other than showing them to you.

You confirm you have the rights to the content you upload, including any photographs of people.

The assistant produces drafts. It can be wrong, incomplete, or miss a hazard that matters on your site.

You must review and approve every brief before publishing it. Publishing a brief is your decision and your responsibility, and we are not liable for the content of a brief you publish.

The same applies to translations. Every translated brief carries a notice that, in case of discrepancy, the English version applies.

Paid plans are billed monthly in Australian dollars through Stripe. Current plans are:

• Free — one tenant, one brief, no AI assistant.
• Basic, $10/month — one tenant, ten briefs.
• Pro, $20/month — three tenants, twenty-five briefs per tenant.
• Pro+, $30/month — ten tenants, fifty briefs per tenant.

Paid plans start with a 14-day free trial. If you do not cancel before the trial ends, the plan continues and the first monthly payment is taken.

If you cancel during the trial, your account reverts to the Free plan. Content beyond the Free plan's limits stays in place but may become read-only until you upgrade again.

You may cancel at any time from the billing page. Cancellation stops future payments and your plan continues until the end of the period you have already paid for.

We do not offer refunds for a period that has already started, including partial months after a cancellation or downgrade.

Nothing in this section limits your rights under the Australian Consumer Law. If a service we supply fails a consumer guarantee, you may be entitled to a remedy that this clause cannot exclude.

We will use reasonable efforts to keep BriefDuty available, but we do not commit to a particular level of uptime and we do not offer service credits.

We may need to take the service down for maintenance, and we may change or discontinue features. Where a change materially reduces what a paid plan does, we will tell account holders by email.

Because published briefs are served over the internet to your readers' own devices, we cannot guarantee a brief will be reachable from every network at every moment.

You can delete briefs, documents and tenants at any time. Deletion is immediate and permanent: we do not keep backup copies, and we cannot restore content once it is gone.

Export or keep your own copy of anything you may need later, including reader records you rely on for compliance purposes.

To the extent permitted by law, neither party is liable for indirect or consequential loss, loss of profits, or loss of data.

To the extent permitted by law, our total liability arising out of or in connection with these terms is limited to the greater of AUD $100 and the fees you paid us in the twelve months before the claim arose.

Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Australian Consumer Law.

You may stop using BriefDuty and close your account at any time.

We may suspend or terminate access if you breach these terms, if payment fails and remains unpaid, or if we are required to by law. Where it is reasonable to do so, we will contact you first and give you a chance to fix the problem.

On termination your right to use the service ends. Sections that by their nature should survive — content ownership, liability, and governing law — continue to apply.

We may update these terms as the product and the law change. The effective date at the top of this page will change, and we will notify account holders of material changes by email.

Continuing to use BriefDuty after a change takes effect means you accept the updated terms.

These terms are governed by the laws of Western Australia, and each party submits to the non-exclusive jurisdiction of the courts of that state.
